Terms & Conditions
These Terms & Conditions apply to business relations between IDZIOREK-BURGSTALLER KG, Obere Donaustraße 11/2/4, 1020 Vienna, Austria and the customer, in their current version.
Our offer is directed at customers who are consumers only, those natural persons who conclude a legal transaction for purposes, that can not be attributed predominantly neither to their commercial nor to their independent professional activity.
The products shown in our web shop do not constitute a legally binding offer. This is a non-binding online catalog of our product range.
§ 1 Contract Language
The contract language is German or English, depending on the language in which the customer places his order.
§ 2 Contract Conclusion (and Correction of Input Errors)
An order is only possible if all mandatory marked fields * are filled in correctly in the order form. If information is missing or if we can not fulfill the order for other reasons, the customer will receive an error message. The customer can correct his input at any time during the entire ordering process using the common keyboard and mouse or touch screen functions. The customer receives detailed supporting information during the ordering process.
By clicking on the button "Confirm Order" or “Pay Now”, the customer submits a binding order for the items in the shopping cart. Once the order is completed, the customer will see the notification "Order received successfully". The customer immediately receives an "order reception confirmation" via e-mail to the e-mail-address provided by the customer. The customer is requested to check the order reception confirmation immediately for errors and to contact us if necessary at firstname.lastname@example.org, tel.: +43 (0) 676 7889935.
The customer's order constitutes an offer. A contract is only concluded after our acceptance. The customer is informed of our acceptance by the "order confirmation" via e-mail. By receiving the order confirmation a contract of purchase is concluded.

§ 3 Binding the Customer to His Offer
The customer is bound to his order for 2 days after placing an order. The legal right of withdrawal remains unaffected.
§ 4 Storage and Accessibility of the Contract of Purchase
§ 5 Destination Country
Our offer is exclusively for customers with residence in the European Economic Area (EEA) and Switzerland as well as the USA and Canada.
§ 6 Prices, Shipping Costs & Delivery Times
All prices listed in our web shop are total prices. They include all taxes including VAT and duties but excluding shipping costs. The shipping costs can be found at our Shipping Costs & Delivery Times overview.
If delivering to a non-EEA country (Switzerland, USA or Canada), the consumer must bear all import and export charges, including any duties and fees.
Unless otherwise agreed, the products will be delivered without undue delay, at least not later than 30 days after the conclusion of the contract.
§ 7 Payment Methods
We accept the following payment methods: Bank transfer, eps-Überweisung and Giropay.
§ 8 Due Date / Payment in Advance
The customer is bound to pay in full for the purchase price upon conclusion of the contract. The delivery of the control room will take place afterwards.
§ 9 Retention of Title
The ordered products remain property of IDZIOREK-BURGSTALLER KG, Obere Donaustraße 11/2/4, 1020 Vienna, Austria until full payment of the entire purchase price including shipping costs took place.
§ 10a Right of Withdrawal
The customer has the right to withdraw from this contract within fourteen days without any reason.
The cancellation period is fourteen days from the day on which the customer or a third party named by him, who is not the delivery company, has taken possession of the entire shipment.
To exercise the right of withdrawal, the customer must contact us (IDZIOREK-BURGSTALLER KG, Obere Donaustraße 11/2/4, 1020 Vienna, Austria, tel.: +43 (0) 6767889935, e-mail: email@example.com) by means of a clear statement (e.g. a letter sent by post or e-mail) about his decision to withdraw from this contract. The customer has the option to use the attached model withdrawal form, which is not obligatory.
The customer can electronically complete and submit a clear statement in our web shop at Returns. If the customer make use of this option, we will promptly send him a confirmation of the withdrawal via e-mail.
To be considered within the withdrawal period, it is sufficient that the customer sends the statement before the expiry of the withdrawal period (of fourteen days from the day of delivery of the products).
§10b Consequences of the Cancellation
If the customer withdraws from the contract, we will refund the full amount of the purchase Including delivery fees (except the additional costs that have resulted from choosing a different type of delivery than the standard delivery provided by us), no later than fourteen days from the day on which the notification of the customers withdrawal from this contract has reached us. For this refund, we will use the same method of payment that the customer used in the original transaction, unless otherwise agreed.
We reserve the right to refuse to refund the purchase until we have received the products back or until the customer has provided proof that you have returned the products, whichever is the earlier.
The customer must send the products within fourteen days from the date on which he informed us about the cancellation of the contract to IDZIOREK-BURGSTALLER KG, Obere Donaustraße 11/2/4, 1020 Vienna, Austria.
The deadline is met if the customer sends the products before the deadline of fourteen days.
The customer bears the immediate costs of returning the products.
The customer only has to pay for a possible loss in value, if this loss of value is due to inappropriate handling of the product.
§ 11 Reference to the Statutory Warranty
The conditions of the statutory warranty apply. The warranty period for the delivery of movable products is 2 years from the date of receiving the product.
§12 Transport Damage
If a product is damaged during transport, the customer is obliged to report this damage immediately to the transport / shipping company, before contacting us for a replacement.
§ 13 Customer Service / Complaint

§14 Out-of-Court Dispute Resolution
The Commission of the European Union is providing an (ODR-platform) online-platform for dispute resolution under the following link http://ec.europa.eu/odr.
Consumers living in the European Union can use this platform to resolve disputes regarding contractual obligations that result from online contracts, outside of court.
We are obliged to inform you about the existence of this platform. Yet we are not obliged to participate in a dispute settlement proceeding in front of a consumer arbitration board.

§ 15 Final Term
If individual terms of these Terms & Conditions do not apply, the validity of the remaining terms remains unaffected.
